Before we begin

Version 6. Effective 1 November 2026.

Last updated: 1 November 2026.

This is separate from our Terms of Service and Privacy Policy. Please read it before you write anything.

You are making this agreement with D2X Enterprises LLC, which provides ToldForward as a service.

1. What may be sensitive

Our questions cover your whole life. What you write may include things the law treats as sensitive, such as:

• your health, or the health of someone in your life
• your reproductive or sexual health, such as pregnancy, fertility or contraception
• your religious or philosophical beliefs
• your sex life, sexual orientation or gender identity
• your racial or ethnic origin, national origin, citizenship or immigration status
• union membership, or a crime you were a victim of
• private things about other people

This covers your answers, your own writing, the notes in your family tree and your About you answers.

2. What we do with it

• Keep it, encrypted, with Cloudflare, which hosts and runs our service and stores it in the United States, and in backups encrypted with a key only we hold (Privacy Policy, section 8).
• Show it to you, and to a helper only if you choose one, for what they help you with.
• With Archive Membership, index it so the guide can find your exact words. To build the index, we send the text of your passages to an open model (BGE-M3) that Cloudflare runs for us, which does not learn from them or keep them, and may run outside the United States. Record Membership’s record is never indexed or sent to an AI model.
• With Archive Membership, let the guide answer from it. Until our public launch, the guide sends the passages it found to Claude, a model made by Anthropic, which processes them only in the United States, does not learn from them, and keeps them only for the limited time its standard terms allow. Before our public launch, we will replace it with our own models.
• Translate it on screen when someone reads in another language. Translations are never saved.
• After your death is confirmed and the waiting period has ended, we give a copy of your whole record to every person you designated. With Archive Membership, they may also ask the guide about it. Your About you answers stay private to you and are never included.
• Send a copy to a library or archive only if you choose a Historical Deposit and sign its deed of gift.

3. What we never do

• We never sell it.
• We never use it for advertising.
• We never use it to train AI unless you separately opt in.
• We never share it with anyone else. There are only two exceptions. Companies that run parts of the service for us may handle it, only for us and under contract: Anthropic, as above, and Cloudflare, which runs the service, stores it and builds the index, as above, and whose network carries what you write between you and us and may decrypt it on the way, wherever you are. Google keeps encrypted copies of our backups, which it cannot read. And we disclose it when a law, court order or warrant requires it. Our staff can open it only when they need to, to keep the service running or safe, and every time they do is logged.

4. It is your choice

• Only you can give this consent. A helper or family member cannot give it for you.
• You can skip any question. No question requires you to write about your health or anything else on the list above.
• While you are living, you can edit or delete anything you wrote, at any time. Editing keeps your earlier wording, with its date, in your record. Deleting removes it completely.
• If you say no, you can still look around, but we cannot save answers or writing.

5. Withdrawing

You can withdraw either consent at any time in Settings, as easily as you agreed. Both are needed to write, so from then on we save nothing new.

Anything already in your record may be sensitive, and we cannot keep it without being able to hand it on as you agreed, so withdrawing either consent also means we delete your answers, your writing, the notes in your family tree and your About you answers within 15 days. We first offer you a full copy to download. The people you designated would then receive only what is left, such as the names and dates in your family tree.

Version 1. Effective 30 October 2026.

This is separate from our Terms of Service, our Privacy Policy and the Participant Agreement. It is your own direction to us about your record, given through ToldForward’s online tool.

You are making this direction to D2X Enterprises LLC, which provides ToldForward as a service.

1. What it says

Your record goes only to the people you designate in ToldForward, as and when our terms say: after your death is confirmed and the waiting period has ended.

You direct us not to disclose your record, any part of it, or a list or catalogue of what it holds to anyone else, even if the law would otherwise let them ask for it. That includes:

• the executor or personal representative of your estate;
• an agent acting for you under a power of attorney;
• a guardian, conservator or trustee acting for you or your estate;
• anyone else acting as a fiduciary for you.

We will disclose to them only if a court orders it, or the law requires it whatever you direct.

2. Why it matters

Most states have a law on fiduciary access to digital assets (in many, the Revised Uniform Fiduciary Access to Digital Assets Act). Under those laws, a direction you give through an online tool like this one comes before your will, a trust, a power of attorney and our terms. Without it, an executor or agent could ask us for a list of what your record holds, and in some cases for parts of it.

Your designations in ToldForward are part of the same direction: they say who receives your record.

3. What it does not change

• The people you designate still receive your whole record, as our terms describe.
• An agent or guardian approved under our process can still help with your account’s administration, such as billing, cancelling and contact details. They never read, write or answer for you.
• Your executor can still close your account and receive any refund owed to your estate.
• If you live in Delaware, Louisiana or Massachusetts, your state’s law may not give an online tool this priority. Say the same thing in your will too; our model will clause does.

4. Changing your mind

You can withdraw this direction at any time in Settings, and give it again. If you withdraw it, the law of your state decides what a fiduciary may ask us for. We keep a record of each time you give or withdraw it.
